The purpose of the Terms of Use is to define the rules governing the relationship between the Falke Institute and users on the Platform, without prejudice to the provisions of applicable law.

Who are the Parties?
You: an individual who has qualified through the registration system administered and made available by the FALKE INSTITUTE at the website https://ifalke.com/pt-BR/.
FALKE INSTITUTE: FALKE CURSO DE DESENVOLVIMENTO MEDICO LTDA., a private legal entity, duly registered with the CNPJ under No. 33.182.466/0001-04, with its headquarters and place of jurisdiction in the city of Araucária, State of Paraná, at Av. Archelau de Almeida Torres, 197 – 1st floor – Suite 3 – Downtown – Araucária – PR, ZIP Code 83.702-185,
This document sets forth the terms of use for the Platform and constitutes a contract between You and the FALKE Institute. By enrolling in the Course and using the services offered through the Platform, You expressly agree to all of its terms and conditions and to the applicable legal provisions.
To ensure that we do not encounter any problems and that everything remains within legal parameters, you must read and follow these Terms of Use and our Privacy Policy, which is an integral part of this document and is available at the following link: https://ifalke.com/pt-BR/politica-privacidade.
What is the purpose of these Terms of Use?
These Terms of Use govern your enrollment in the course offered by the Falke Institute.
The course includes hands-on training and distance learning (EAD) through a set of instructional materials made available via a specific, selected platform.
The educational materials are developed by the Falke Institute and are designed to support the educational and practical development of physicians, with a focus on learning through modules related to robotic surgery.
You hereby declare that you are aware that the Robotic Surgery Course is regulated in accordance with the guidelines of the AMB (Brazilian Medical Association) and Brazilian medical societies.
You hereby declare that you are aware and agree that the Falke Institute bears full responsibility for the Course, including its content, the planning of the services provided, the organization of modules and schedules, as well as the class times and the availability of online classes—through a virtual environment specifically designed for this purpose—and the dates for the practical training sessions.
These Terms of Use will be in effect from the date of enrollment until the scheduled end date of the course.
How does registration work?
Enrollment will be formally confirmed upon your express agreement to the provisions of these Terms of Use, via an electronic confirmation available on the Falke Institute’s homepage. Enrollment will only be considered complete after payment has been confirmed.
Registration can be completed online, by phone, or through instant messaging apps (such as WhatsApp), as provided in this agreement.
In the event of non-payment of the registration fee, the Falke Institute reserves the right to cancel your registration and the provision of course materials, as well as to deny you access to the Platform and other learning environments.
How does our Virtual Platform work?
The information will be provided online through the virtual platform and live streaming, in accordance with the notices, tutorials, and schedule that will be made available in the student’s virtual portal.
The video lessons and other instructional materials will be available in the virtual learning environment for as long as you remain enrolled at the Falke Institute—that is, for the duration of the course—with no limit on the number of views.
The Falke Institute reserves the right, without prior notice, to temporarily suspend access to the learning platform for short periods of time for maintenance or security updates, when security considerations warrant it, and always in a manner that does not hinder its development.
The username and password you provided for registration with the Falke Institute are for your personal use only and are non-transferable. You will be held liable for any misuse and for all damages resulting from making them available to third parties, regardless of whether such disclosure was for profit.
The educational material made available to you, through any medium or format (audio, video, text, etc.) is protected by copyright under Law No. 9,610/1998, as it constitutes a work created by the Falke Institute. Please note that the license is granted for your exclusive use and does not constitute any transfer of rights to use, install, market, and/or reproduce the material.
If the Falke Institute determines that the student—or any person using the student’s login and password—is using the material for purposes other than those set forth in this agreement, a fine equal to five times the course fee shall be imposed as compensation for copyright infringement, in addition to the immediate termination of this agreement.
How does payment for the course work?
Payment can be made through the PAGSEGURO platform or directly to the Falke Institute.
If payment is made after the due date, a penalty of 2% (two percent) will be added to the overdue installment, adjusted for inflation based on the positive variation of the IGP-M, plus interest of 1% (one percent) per month, in accordance with Article 406 of the Civil Code, calculated on a pro rata basis.
Your failure to use the resources and access the virtual platform does not exempt you from making payments or fulfilling your other obligations, and the Falke Institute is not required to provide any type of refund or reimbursement.
In the event that a student withdraws or changes their mind
If you withdraw from the course, you may request a refund for the modules you did not complete, as follows:
The cancellation request must be submitted via email to organizacao@ifalke.com. If this request is not submitted, billing will continue, and you will be required to pay all installments specified at the time of enrollment; the Falke Institute may take appropriate collection measures.
If a student changes their mind, the Consumer Protection Code (CDC) guarantees their right to a full refund of the course fee within seven (7) days of enrollment.
How will the certificate be issued?
The certificate will be issued by the Falke Institute in accordance with Brazilian medical societies.
The certificate will be issued upon passing the Final Exam for the Robotic Surgery Course.
The issuance of the certificate is contingent upon proof of all payments.
What are your responsibilities?
► Keep your registration information up to date;
► Do not reproduce or distribute course materials in any form, under penalty of civil and criminal liability in accordance with applicable laws; you are also responsible for ensuring the confidentiality of your password and login information, so as to prevent their sharing in any way;
► Do not send messages containing inappropriate content in private instant messaging groups, such as nudity, sexual or political content, or content that in any way violates ethical standards or decency; failure to comply may result in exclusion from the groups by the Falke Institute;
► Have the equipment and software necessary to view the video materials on the virtual platform, in accordance with the minimum requirements established by the Falke Institute, namely: a computer with broadband Internet access and one of the following web browsers: Internet Explorer 8 or higher, Mozilla Firefox, or Google Chrome;
► Do not use another student's account without prior authorization or impersonate someone else.
► Collect content from students and users, or access our platform using automated means (such as data collection bots, robots, or web scrapers) without our prior permission.
A violation of any of the terms and conditions in this document may, at our sole discretion, result in the immediate suspension of access to our Platform, products, or services.
What are the Falke Institute's obligations?
► Provide access to the online platform after enrollment is complete; access will be restricted and requires a username and password;
► Provide instructional materials and tutoring services to guide the learning process;
► Provide hands-on training;
► Teach the courses offered through distance learning;
► Ensure the quality and effective delivery of educational services.
Other provisions regarding these Terms of Use:
The Falke Institute is not responsible for any issues related to internet access, video content, or the Platform, nor for the user’s internal network settings, which may require special configuration to access the Platform.
You acknowledge that minor programming errors (“bugs”) or internet connection outages are common in technology systems, and therefore the Falke Institute is not liable for any problems arising from such “bugs.” The Falke Institute’s liability is limited to correcting any issues that may arise during compliance with these Terms of Use.
Any tolerance by the parties regarding a breach of any of the provisions set forth herein shall not constitute a waiver, forgiveness, novation, or amendment of the provisions of this instrument.
If any provision of these Terms of Use is deemed invalid or voidable, that provision shall be deemed severed from this agreement, and the remaining provisions shall remain valid and in full force and effect.
This agreement constitutes the entire agreement between You and the Falke Institute and is governed by Brazilian law. The courts of Araucária, Paraná, are hereby designated as the sole competent jurisdiction for resolving any disputes arising from this agreement, and You hereby expressly waive any other jurisdiction, no matter how preferential it may be.
